Referral Program Terms
1. Introduction & Acceptance of Terms
WebWork Time Tracker, Inc. (“WebWork,” “we,” “us,” or “our”) operates the WebWork Referral Program (“Referral Program” or “Program”) to reward existing customers who refer new workspaces to the WebWork platform. These Referral Program Terms (“Referral Terms”) govern your participation in the Program and form a supplement to the WebWork Terms of Service available at www.webwork-tracker.com/terms-of-service. In the event of a conflict between these Referral Terms and the Terms of Service, these Referral Terms shall prevail with respect to matters relating to the Referral Program.
BY JOINING THE REFERRAL PROGRAM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE REFERRAL TERMS. IF YOU DO NOT AGREE, YOU MUST NOT PARTICIPATE IN THE PROGRAM.
2. Definitions
Referral Program: The WebWork program through which eligible participants earn balance by referring new workspaces to the WebWork platform.
Referrer: A workspace participating in the Referral Program through an eligible Workspace Owner or Executive Manager who has joined the Program on behalf of that workspace.
Referral Link: A unique tracking link generated for each participating workspace, used to attribute new workspace registrations to the Referrer.
Referred Workspace: A new workspace that registers on the WebWork platform using a Referral Link.
Referral Earnings: The amount earned by a Referrer through the Program. Referral Earnings are credited to the workspace’s WebWork balance, which is the general balance system used for all payments on the WebWork platform. The Referral Program page in the dashboard displays earnings attributed to the Program, but all earned amounts form part of the workspace’s unified WebWork balance.
Qualified Referral: A Referred Workspace that has been reviewed and approved by WebWork in accordance with Section 6 of these Referral Terms.
Commission Period: The twelve (12) month period beginning from the date of the Referred Workspace’s first payment, during which the Referrer is eligible to earn Referral Earnings from that Referred Workspace’s payments.
3. Eligibility & Enrollment
The Referral Program is available to workspaces with an active paid subscription to any WebWork plan. Participation in the Program is at the workspace level, not the individual user level.
The following users are eligible to join the Program on behalf of their workspace:
- Workspace Owners: The individual or entity that created the workspace.
- Executive Managers with Billing Permission: Users who have been granted executive-level access with workspace billing permissions.
When an eligible user joins the Program, the workspace itself becomes enrolled. If one eligible user has already joined, other eligible users within the same workspace will see the enrollment status and referral data but will not need to join separately. The Referral Program, including all associated data and earned balance, is tied to the workspace. If the user who originally enrolled in the Program leaves or is removed from the workspace, the workspace’s participation in the Program and any accrued balance remain unaffected.
The Referral Program is separate from the WebWork Affiliate Program. Participation in both programs simultaneously is not recommended. Where a workspace is associated with both a referral link and an affiliate link, only one link will be applied to any given Referred Workspace. A single registration cannot generate rewards under both programs.
4. How the Referral Program Works
Upon enrollment, the participating workspace receives a unique Referral Link accessible from the Referral Program page within the WebWork dashboard.
The referral process operates as follows:
- The Referrer shares their Referral Link with prospective users.
- A new user registers on the WebWork platform using the Referral Link. The referral is tracked at the workspace level. The Referral Link has an attribution window of twenty (20) days from the date the prospective user first clicks the link. If the prospective user does not register within this window, the referral will not be attributed to the Referrer.
- Once the Referred Workspace makes a payment, the referral enters an awaiting approval status.
- WebWork reviews the Referred Workspace in accordance with Section 6 and, upon approval, the Referrer’s workspace is credited with an amount equal to twenty percent (20%) of the Referred Workspace’s payment. This amount is added to the workspace’s WebWork balance.
There is no limit on the number of workspaces a Referrer may refer. Each Referred Workspace that becomes a Qualified Referral is treated independently.
A workspace that was itself referred through the Program may also enroll in the Program and refer additional workspaces. However, multi-tier or chain commissions are not supported. Each Referrer earns exclusively from the payments of the workspaces it directly referred.
5. Referred Workspace Discount
Workspaces that register using a valid Referral Link are eligible to receive a discount of ten percent (10%) on their WebWork subscription payments. This discount is applied automatically and does not require a coupon or promotional code.
The discount applies as follows:
- For monthly billing cycles: the discount applies to the first three (3) monthly payments.
- For annual billing cycles: the discount applies to the first annual payment.
The referral discount cannot be combined with other active promotions, discounts, or special offers. If another promotion is available at the time of registration or payment that provides a higher discount than the referral discount, the higher discount will apply for its applicable period. The discounts are not additive.
6. Approval and Qualification of Referred Workspaces
Not all Referred Workspaces will automatically qualify for Referral Earnings. Upon a Referred Workspace’s first payment, WebWork will review the referral to determine whether it meets the Program’s qualification criteria. WebWork reserves the right to approve or reject any referral at its sole discretion.
Without limiting WebWork’s discretion, factors that may result in the rejection of a referral include, but are not limited to:
- The Referred Workspace is not a genuinely new customer and is associated with a previously existing WebWork account or workspace.
- The Referred Workspace is owned, controlled, or operated by the same individual or entity as the Referrer, or is otherwise a related party.
- The payment associated with the referral has been refunded, charged back, or otherwise reversed.
- The referral was generated through fraudulent, deceptive, or abusive means.
- The Referred Workspace violates the WebWork Terms of Service.
WebWork will make commercially reasonable efforts to complete the review process in a timely manner. WebWork will notify the Referrer of the outcome through the Referral Program page in the dashboard.
7. Referral Earnings and Balance
Upon approval of a Qualified Referral, the Referrer’s workspace will be credited with an amount equal to twenty percent (20%) of the Referred Workspace’s payment. This amount is added to the workspace’s WebWork balance.
Commission Period: The Referrer will earn from a Qualified Referral’s payments for a period of twelve (12) months from the date of that Referred Workspace’s first payment. Payments made by the Referred Workspace after the expiration of the Commission Period will not generate earnings for the Referrer.
Nature of Balance: Referral Earnings are credited to the workspace’s general WebWork balance. This balance may be used for any payments on the WebWork platform, including subscription payments, AI credit purchases, and other WebWork services. The WebWork balance is applied automatically when payments are due. The balance has no cash value and cannot be withdrawn, transferred, or converted to any form of monetary payout.
No Expiration: The WebWork balance does not expire, except as otherwise provided under Section 10 of these Referral Terms.
No Minimum Threshold: There is no minimum balance required before it can be applied toward payments.
8. Prohibited Conduct
Participants in the Referral Program must act in good faith and in compliance with these Referral Terms, the WebWork Terms of Service, and all applicable laws and regulations. The following conduct is prohibited:
- Referring workspaces that are owned, controlled, or operated by the Referrer or any individual or entity affiliated with the Referrer.
- Creating fake, temporary, or fraudulent workspaces for the purpose of generating balance.
- Using misleading, deceptive, or inaccurate information about WebWork or its services to generate referrals.
- Using unsolicited commercial email (spam), automated systems, or other prohibited methods to distribute the Referral Link.
- Manipulating or attempting to manipulate the referral tracking system.
- Any other activity that WebWork determines, in its sole discretion, to be fraudulent, abusive, or contrary to the spirit of the Program.
Violation of these prohibitions may result in the immediate removal of the workspace from the Program, forfeiture of any accrued balance, and any other remedies available to WebWork under the Terms of Service or applicable law.
9. Fraud and Clawback
If WebWork determines, at any time, that balance was earned through fraudulent, deceptive, or abusive activity, or through a violation of these Referral Terms, WebWork reserves the right to:
- Reverse or deduct the corresponding amount from the workspace’s WebWork balance.
- Reject any pending referrals associated with the prohibited conduct.
- Suspend or permanently remove the workspace from the Referral Program.
If a payment from a Referred Workspace that generated Referral Earnings is subsequently refunded, charged back, or otherwise reversed, WebWork reserves the right to deduct the corresponding amount from the Referrer’s WebWork balance.
10. Termination and Removal
Termination by You: A workspace may withdraw from the Referral Program at any time by contacting WebWork support at [email protected].
Termination by WebWork: WebWork reserves the right to remove any workspace from the Referral Program at any time and for any reason, including but not limited to violation of these Referral Terms, violation of the Terms of Service, fraudulent activity, or abuse of the Program.
Effect on Balance: In cases of fraud, abuse, or material violation of these Referral Terms, WebWork reserves the right to forfeit any remaining balance earned through the Program. In all other cases of program termination or removal, earned balance will be honored and may continue to be applied toward WebWork platform payments until depleted.
Upon removal from the Program, the workspace will no longer earn from any Referred Workspaces, including those still within their Commission Period.
11. Program Modifications
WebWork reserves the right to modify, suspend, or discontinue the Referral Program, in whole or in part, at any time. This includes the right to change the commission percentage, the Commission Period, the Referred Workspace discount, eligibility requirements, and any other aspect of the Program.
WebWork will notify participants of material changes to the Program via email or through the WebWork dashboard. Continued participation in the Program after notification of changes constitutes acceptance of the modified terms.
12. Limitations of Liability
The Referral Program is provided on an “as is” and “as available” basis. WebWork makes no representations or warranties regarding the continued availability of the Program, the approval of any particular referral, or the amount of balance that may be earned.
WebWork is not liable for any indirect, incidental, consequential, or special damages arising from or related to participation in the Referral Program, including but not limited to lost revenue, lost profits, or loss of expected earnings.
13. Indemnification
Participants agree to indemnify, defend, and hold harmless WebWork, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from the participant’s activities in connection with the Referral Program, including but not limited to any misrepresentation of WebWork or its services, violation of these Referral Terms, or infringement of any third-party rights.
14. Governing Law and Dispute Resolution
These Referral Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of laws principles.
Both You and We agree to attempt to resolve any disputes through direct negotiations within thirty (30) days of a written dispute notice. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Delaware, USA.
15. Relationship of the Parties
Participation in the Referral Program does not create an agency, partnership, joint venture, employment, or franchise relationship between the participant and WebWork. Participants are not authorized to make any representations, commitments, or agreements on behalf of WebWork.
